Another thing to keep in mind is that fractionalized promissory notes and deeds of trust are subject to regulation by the DRE (Real Estate Law) and the DOC (Securities Law). You may recall that the Real Estate Law is also known as the “multi-lender law.” You might wonder why these laws exist; to put it simply, these laws enforce restrictions such as the mortgage Mortgage broker must service your Mortgage and have a written agreement with you and no more than ten lenders at a time on a single investment.
